If the server is..
located in Germany, then Germany has jurisdiction over the server. However, you could be prosecuted by any country including Italy and the United States.

What I am saying..
is that if the server is in Germany, Germany has jurisdiction over the SERVER, but if you commit crime with it, you can be prosecuted no matter what jurisdiction YOU are under.
