It appears that the lawsuit stemming from the cancellation of the long-delayed Duke Nukem Forever has been settled out of court.
Gamasutra is reporting that Take-Two Interactive and 3D Realms have opted to dismiss the lawsuits that were filed shortly after development was canceled in May 2009.
"Each party is to bear its own portion of the costs of this litigation, and each party further agrees not to seek any costs or sanctions," reads a short document that was filed with the New York District Court.
The suits were dismissed with prejudice, meaning that neither party can file another suit based on the same claims.
